1. Seller
Vortex Thumbs is a service published by Vortex Studio (Micro-entreprise, France), SIRET 94340681900012, registered office: Rue du Centre, 38510, Courtenay.

2. Scope
These terms of sale (the "Terms") govern every purchase of credits on Vortex Thumbs (the "Service") by a customer (the "Customer"). Placing an order implies full acceptance of the Terms in force on the day of the order. They complement the terms of use and the legal notice of vortexstudio.fr.
3. What is sold
The Service sells digital credits. Credits are spent to generate or edit images with an artificial-intelligence model, at the rate displayed in the Service before each generation (the "credit grid"). Credits are a unit of use of the Service: they are not money, carry no interest and cannot be exchanged for cash.
Credits are sold in packs. The content of each pack (price, number of credits, bonus) is displayed on the pricing page at the time of purchase.
4. Account
Buying and spending credits requires a Vortex account, shared with vortexstudio.fr. The Customer is responsible for the confidentiality of their credentials and for every action performed from their account. The Customer must be at least 18 years old, or hold the authorization of a legal guardian.
5. Prices and payment
Prices are displayed in euros, all taxes included. The applicable VAT is stated on the receipt.
Payment is made through PayPal, with a PayPal account or a bank card processed by PayPal. Vortex Studio never receives or stores card numbers. Credits are added to the Customer's balance as soon as PayPal confirms the payment, in general within a few seconds. A receipt is available from the account.
Vortex Studio may change its prices at any time. The price applied is the one displayed at the time of the order. Credits already purchased are not affected by a later change of pack prices. The credit grid (credits per image) may however evolve with the cost of the underlying models; the cost in force is always shown before a generation is launched.
6. Credits
- No expiry. Credits remain on the account until they are used.
- Non-transferable. Credits are attached to the account that purchased them and cannot be transferred to another account or another person.
- Non-refundable. Credits, whether used or not, are not refunded, except in the case below.
- Automatic refund on technical failure. When a generation fails for a reason attributable to the Service or to the model (error, timeout, no image returned, refusal by the model), the credits charged for that generation are returned to the balance automatically. A generation that completes but whose result does not match the Customer's expectations is not a technical failure.
7. Right of withdrawal
Credits are digital content supplied immediately, without a tangible medium. In accordance with article L221-28, 13° of the French Consumer Code, the right of withdrawal cannot be exercised for such content once performance has begun with the consumer's prior express consent and express waiver of their right of withdrawal.
By confirming an order, the Customer expressly requests immediate delivery of the credits and expressly waives their right of withdrawal. This waiver is recorded at checkout.
8. Acceptable use
The Customer agrees to use the Service lawfully and, in particular, not to:
- generate content that is illegal, defamatory, hateful, sexually explicit, or that depicts real people without their consent;
- infringe third-party rights, including the intellectual-property rights of Epic Games, Inc. and of other rights holders;
- circumvent the Service's safety rules, quotas or technical limits, or automate access outside the features offered;
- resell credits or access to the Service.
The Customer remains responsible for compliance with Epic Games' rules (Island Creator Rules, thumbnail image policies) when publishing an image on Fortnite. The Service helps by embedding these rules in its prompts; it does not guarantee acceptance by Epic Games.
9. Trademarks and independence
Fortnite, Unreal and their characters are trademarks of Epic Games, Inc. Vortex Thumbs is an independent service published by Vortex Studio. It is not affiliated with, sponsored by or endorsed by Epic Games, Inc.
10. AI-generated content
Images are produced by an artificial-intelligence model provided by Google (Gemini). As a result:
- Results are not guaranteed. The same request can produce different images, and some requests may be refused by the model, in particular for safety or intellectual-property reasons. A refusal by the model counts as a technical failure and is refunded as described in section 6.
- Invisible watermark. Generated images carry an invisible SynthID watermark identifying them as AI-generated. The Customer agrees not to remove it.
- Responsibility. The Customer is solely responsible for checking each image before publication and for the use they make of it. Vortex Studio does not review generated images before delivery.
- Rights. Subject to third-party rights and to the terms of the model provider, Vortex Studio claims no ownership over the images generated for the Customer, who may use them to promote their own Fortnite islands. Vortex Studio displays an image in the Service's public gallery only if the Customer submits it and it is approved.
11. Availability
Vortex Studio does its best to keep the Service available but does not guarantee continuous operation. The Service depends on third-party providers (Google, Supabase, PayPal, Vercel). Scheduled maintenance and incidents may suspend generation temporarily; credits are not affected.
12. Suspension and termination
Vortex Studio may suspend or close an account, without refund of the remaining credits, in the event of:
- a breach of section 8 (acceptable use);
- fraud, abuse, or attempts to circumvent the Service;
- a chargeback or a payment dispute opened with PayPal on an order whose credits were delivered. The disputed credits are then removed from the balance, which may become negative until the situation is settled.
The Customer may close their account at any time from their account settings. Remaining credits are then lost and are not refunded.
13. Liability
Vortex Studio is bound by an obligation of means. To the extent permitted by law, its liability for any damage related to the Service is limited to the amount paid by the Customer over the twelve months preceding the event. Vortex Studio is not liable for the decisions of Epic Games regarding the Customer's islands or thumbnails, for the content the Customer chooses to generate or publish, or for indirect damage (loss of revenue, audience or data).
Nothing in these Terms limits the rights that consumers hold under mandatory law.
14. Personal data
The processing of personal data related to the Service is described in the privacy policy.
15. Changes to the Terms
Vortex Studio may update these Terms. The version applicable to an order is the one in force on the day of the order. The date of the last update is shown at the top of this page.
16. Governing law and disputes
These Terms are governed by French law. In the event of a dispute, the Customer is invited to contact Vortex Studio first at hello@vortexstudio.fr; an amicable solution will be sought.
In accordance with articles L611-1 and following of the French Consumer Code, consumers may use a consumer mediator free of charge. The mediator designated by Vortex Studio is provided on request at hello@vortexstudio.fr, before any referral.
Failing an amicable solution, the competent courts are those designated by the French Code of Civil Procedure.
